Notwithstanding the foregoing, in order to resolve any dispute of any third party (i.e. a dispute between you and any other party, not us) concerning or arising out of the use of domain names registered hereof, without prejudice to any other potentially applicable jurisdiction, you will determine the subject matter and personal jurisdiction of the courts (i) of the place of residence of the registrant, as set forth in the public RDDS registration for disputed domain names, and (ii) where we are located, currently state or federal courts whose geographic counties include Denver, Colorado. What the purchase contract creates is a right for the buyer to buy the property in question under certain conditions. Likewise, the seller receives the right to receive the consideration from the buyer in accordance with its part of the General Conditions. It is clear from the above definition that a purchase contract contains a promise to transfer a property in question in the future if certain conditions are met. This agreement itself therefore does not create any right or interest in the property for the proposed buyer. A purchase contract is a contract for the sale of a property in the future. Thus, if you have purchased a property under a purchase agreement without an appropriate deed of sale, you will not receive any right or interest in the property that is allegedly transferred under the purchase agreement.
In the event of the seller`s failure to sell or hand over the property to the buyer, the buyer is entitled to certain services under the provisions of the Specific Repairs Act 1963. A similar right is available for the seller under the contract to receive a specific service from the buyer. We hold the following information for registrations for which we are the registrar: (a) the date of creation of the original registration, (b) the expiry date of the registration, (c) the name, postal address, e-mail address, voice telephone number and, if applicable, the fax number of the registrant and all contacts for the registration of the domain name, (d) any remarks regarding the registered domain name, which appear or should appear or appear in the RDDS or a similar database, and (e) any other information that we generate or receive in connection with the provision of services, with the exception of the registered domain name name, the IP addresses of the primary name server and any secondary name server for the domain name, and the corresponding names of those name servers….
